The Special Pass; Temporary Work Permit

A special pass is issued to those who wish to enter Kenya and stay for:

  • A limited period for the purpose of applying for a review of a decision denying a permit;
  • Applying for a permit or pass;
  • Temporarily conducting any business, trade or profession;
  • Any other purposes which an immigration officer considers suitable.

It is issued for three months and can be renewed for another three months but, in any case, not exceeding six months. 

The special pass can be used to re-enter Kenya during the period of validity of the pass.

The difference between a special pass and a work permit

The main difference between a work permit and a special pass is that a special pass is a temporary work permit issued for a short period of up to six months, while a work permit is issued for a longer period of between one and two years for a maximum of five years. Persons applying for a work permit can apply for a special pass while awaiting the approval of the work permit.

The special pass also does not have any processing fees. The work permit has both processing and issuance fees.       

East African Gratis

Following the signing of the East African Community (EAC) Common Market Protocol, East Africans can accept employment and establish businesses in any EAC country. Kenya has abolished work permit fees for all East African Nationals working in the country and granted all East Africans gratis. This means that East Africans are exempt from paying special pass issuance fees or work permit issuance and processing fees.

Foreign Nationals Certificate (Alien Card) for special pass holders

All foreigners resident in the country for more than 90 days are required to register as foreign nationals. If the foreigner renews the special pass after three months, the foreigner must apply for an Alien Card. 

Foreigners can access their personal KRA PINs and local banking services with an alien card.

The foreign national`s registration certificate (alien card) expires on the same date as the special pass.
